JUSTICE PURNENDU SINGH ORAL ORDER 02-09-2024 Heard Mr. Vaidehi Raman Prasad Singh, learned counsel appearing on behalf of the petitioner and Mr. Prabhat Kumar Verma, along with Mr. Arvind Kumar, learned counsels appearing on behalf of the respondent/s.
2. The petitioner in paragraph no. 1 of the present writ petition has sought, inter alia, the following relief(s), which is reproduced hereinafter:- "That this is an application for grant of an appropriate writ for a direction to the respondents to grant promotion to the petitioner to the post of Divisional Traffic Manager with effect from
Patna High Court CWJC No.3996 of 2012(4) dt.02-09-2024 2/3 25.07.2005 with all consequential benefits."

Learned counsel appearing on behalf of the petitioner submitted that the petitioner seeks to file a detailed representation before the Administrator, Bihar State Road Transport Corporation for considering his relief(s), as prayed for in the present writ petition. Learned counsel further submitted that the law is well settled in this regard and after the petitioner was illegally made to compulsory retire and thereafter, he was reinstated back in the service, despite of the fact that in the counter affidavit the respondent has stated that the petitioner was holding the post on temporary basis. The petitioner retired on 31.12.2009 and has been deprived of his vital right for being considered for promotion and other consequential financial benefit/s. Learned counsel submitted that persons junior to the petitioner has been promoted.
4. Considering the aforesaid submissions made on behalf of the petitioner, the petitioner if so desire, may file a detailed comprehensive representation before the Administrator, Bihar State Road Transport Corporation and the Administrator, Bihar State Road Transport Corporation is directed to consider the case of the petitioner and dispose of the representation in accordance with law, expeditiously.

5. Accordingly, the present writ petition stands disposed of.
