2. The petitioner has prayed for bail in connection with Salimpur P.S. Case No. 261 of 2024 registered for the offence punishable under Sections 178, 179, 180, 181, 361(2), 318(4), 338, 336(3), 340(2), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The case of the prosecution is that the informant received information that in Rukanpura, a general store and C.S.P. shop prints counterfeit currency from printer. The said general store is run by Priyanka Kumari, wife of Prabhat Kumar, who is the petitioner in the present case and Sonu Kumar also
Patna High Court CR. MISC. No.31228 of 2025(2) dt.20-05-2025 2/3 works in that shop. From perusal of the F.I.R., it also transpires that some counterfeit currency has allegedly been recovered.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It has also been submitted that it is not probable that counterfeit note could be published from a printer and that too in a general store. From perusal of the seizure list, it transpires that the items which have been recovered from the shop does not contain any apparatus for printing note. It is further submitted that the petitioner does not live at his village rather he works in a mall in Ahemdabad. Petitioner is languishing in judicial custody since 11.02.2025.
5. The application for bail is opposed by learned APP for the State and he submits that the petitioner has got one criminal antecedent.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM,
