2. The petitioner apprehends his arrest in a case registered under Sections 8(b), 18 and 29 of the Narcotics Drugs and Psychotropic Substance Act.

3. As per prosecution case, petitioner is alleged to be involved in illegal cultivation of opium plants on large scale over the forest land.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that

Patna High Court CR. MISC. No.27769 of 2025(2) dt.21-05-2025 2/3 petitioner was never seen cultivating the opium plants on the spot and the petitioner was never present on the place of occurrence. Nothing any incriminating or any narcotic item has been recovered either from the conscious or the physical possession of the petitioner or from his house. Similarly situated co-accused person, namely, Kuleshwar Singh @ Bihari Yadav has already been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 15.05.2025 passed in Cr. Misc. No. 31631 of 2025. Petitioner has got one criminal antecedent in which, he is on bail. Petitioner undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cumSpecial Judge, N.D.P.S. Act, Gaya in connection with Barachatti P.S. Case No. 20 of 2025, subject to the conditions as laid down
