2. The petitioner is apprehending arrest in connection with Gaurichak P.S. Case No. 379 of 2019 lodged on 09.09.2019, for the offence punishable under Section 379 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against two named accused persons including the present petitioner. It has been alleged in the FIR that the accused persons initially came at the house of the informant and took away 4-5 tractors of brick and again on the next day, the accused persons again came and took away sand kept at the house of the informant. Thereafter, when the informant received information about the

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the present case has been lodged by the informant only to save the skin from the counter blast case filed by the petitioner's side. He submits that the sister of the petitioner filed a criminal case against the informant and others bearing Agamkuan P.S. Case No. 527 of 2019 dated 10.06.2019 with regard to theft of the documents and killing of her husband. He submits that the petitioner is the pairvikar of his sister. He further submits that the criminal antecedent of the petitioner is not clean as there is one case pending against him in which, he is on bail.
5. Learned APP for the State opposes the prayer for bail of the petitioner but fairly submits that it transpires that the petitioner's sister has lodged a criminal case against the informant and others.
6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as

No.29263 of 2026(2) dt.06-05-2026 3/3 mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of Additional Chief Judicial Magistrate-II, Patna City, in connection with Gaurichak P.S.
