Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 147, 149, 341, 323, 324, 307, 379, 504, 506 of the Indian Penal Code.

Prosecution case in short is that in the garb of some dispute between the parties, the petitioner assaulted the informant with sword on his neck.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge

Patna High Court CR. MISC. No.29865 of 2020(3) dt.08-01-2021 2/2 sheet/Prosecution report in this case has already been submitted. The petitioner is in custody since 31-12-2019. The petitioner has been falsely implicated in the present case. Though the allegation of assault is alleged against the petitioner but the injury is said to be caused on non-vital part of the body. The petitioner has remained in custody for more than one year. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Purnea in connection with Mirganj P.S. Case No. 131 of 2019.
