2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 25(1-b)a, 26, 29 and 35 of the Arms Act.

3. As per allegation in the FIR, on getting secret information, house of Pappu Jha was raided and two persons, namely, Navin Kumar and Rohit Kumar were arrested. On search, three loaded country made pistol having one live cartridge and one empty magazine. They also disclosed the name of other accused persons including the name of the petitioner one of their associates.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He was

Patna High Court CR. MISC. No.34035 of 2024(2) dt.16-05-2024 2/2 not arrested on spot. His name transpired in confessional statement of apprehended two accused persons. Save and except confessional statement of co-accused, nothing has come against the petitioner to show his involvement in the present case. Similarly situated other accused person has already been enlarged on bail by this Court vide order dated 16.01.2024 passed in Cr. Misc. No. 533 of 20224. Petitioner is in custody since 19.12.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Sitamarhi in connection with Sitamarhi P.S. Case No. 608 of 2022.
