The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376 (G) and 506 of the Indian Penal Code, Section 3/4 of the POCSO Act and 67 of the Information Act.

Allegation against the petitioner and other accused persons is of taking picture of the informant and giving threaten to do make viral of the said photo. Modesty of the informant was also outraged.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that the accused persons were not sent up for trial but during the course of trial, the petitioner along with other

Patna High Court CR. MISC. No.30154 of 2022(2) dt.10-11-2022 2/2 accused persons were summoned. He further submits that similarly situated co-accused have already been granted anticipatory bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 66847 of 2021.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Khagaria in connection with Mahila P.S. Case No. 64 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
