The present application has been filed for modification of the order dated 10.12.2018 passed in Cr. Misc. No.61813 of 2018 in connection with Patahi P.S. Case No. 60 of 2018 pending in the Court of the learned ACJM VIII, East Champaran at Motihari to the extent of extending the period of surrender of the petitioner.

It appears that the petitioner preferred Cr. Misc. No. 61813 of 2018 with the a prayer for anticipatory bail in a case registered for the offences punishable under Sections 147,148,149,341,342,323,307,332,333,337 and 353 of the IPC and Sections 3⁄4 of Prevention of Damage to Public Property Act, 1984. Considering the fact that the accusation

No.26545 of 2019(2) dt.31-07-2019 2/3 was against the mob, no specific accusation was levelled against the petitioner and the petitioner being lady, she was granted provisional anticipatory bail for four months and the provisional bail was to be confirmed by the learned Court below after getting report of the concerned police station about the conduct of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner is a lady and was residing outside the State, hence she could not furnish her bail bonds. On the grounds mentioned in the modification application and also keeping in view the statement made in paragraph 3 of the main petition that the petitioner being a lady is not having any criminal antecedent, the period of provisional bail of the petitioner is extended by 10th August, 2019 in connection with the aforementioned case. The learned Court below will get a report regarding conduct of the petitioner from the concerned police station and on being satisfied, confirm the provisional anticipatory bail of the petitioner.

The order dated 10.12.2018 passed in Cr. Misc. No.61813 of 2018 stands modified to the extent indicated above.
