Having secured highest marks in the merit list, petitioner approached this Court by filing the instant writ petition seeking a direction that the letter of selection be issued to her for the post of Angan Bari Sevika at Jabara Angan Bari Center, Nokha in the district of Rohtas.

Counter affidavit reveals that in the process of

Patna High Court CWJC No.8105 of 2015(2) dt.17-07-2019 2/2 selection, one Kamini Devi has been selected on 08.09.2015. Copy of counter affidavit was served on the petitioner's counsel in October, 2016 itself. Till date, the selection of Kamini Devi has not been assailed nor there is any rejoinder or reply to the counter affidavit.

In view of the said development, during pendency of the instant proceedings, the instant proceedings cannot proceed any further in the absence of selected candidate. Writ petitioner, against the selection of Kamini Devi, also had other remedies before the Authorities in terms of the Guidelines, which as per pleadings on record have not been availed.

Writ petition is, therefore, dismissed.
