JUSTICE ARVIND SRIVASTAVA ORAL ORDER 23-03-2023 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner apprehends his arrest in connection with Chapra Town P.S. Case No. 462 of 2020 registered under Sections 341, 323, 354(b), 498(A), 504 and 506/34 of the Indian Penal Code.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely implicated in the present case. There is general and omnibus allegation against the petitioner.

Learned A.P.P. appearing on behalf of the State and learned counsel for the informant opposed the prayer of the

Patna High Court CR. MISC. No.29357 of 2022(10) dt.23-03-2023 2/2 petitioner by contending that petitioner is the husband and there is direct allegation of assaulting and abusing against him to the informant. Moreover, petitioner being the husband of the informant had the responsibility of keeping her with full honor and dignity, in which he failed. Hence, petitioner does not deserve to be granted privilege of anticipatory bail. Having considered the facts and circumstances of the case and nature of the allegation, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected.
