JUSTICE RAMESH KUMAR DATTA ORAL ORDER 15-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has approached this Court on account of alleged non-compliance of the order dated 01.05.2012 passed in C.W.J.C. No.566 of 2012.

The direction of this court by the said order was to the opposite party to consider and dispose of the claim of the petitioner within a period of three months from the date of receipt/ production of a copy of the order and whatever amount was found due and permissible, the same should also be paid to him within a further period of three months thereafter.

In the show cause filed on behalf of the opposite parties, it is stated that the petitioner has done less work and, accordingly, the payments have been made to him.

Patna High Court MJC No.3425 of 2013 (2) dt.15-07-2016 Learned counsel for the petitioner, on the other hand, submits that the length of the road was reduced and width has been widened.

So far as the said dispute is concerned, it does not come within the ambit of the contempt jurisdiction of this Court and for the same, it shall be open to the petitioner to take recourse to appropriate proceedings.

Thus, the order under contempt having been complied with the contempt application is disposed of with the above observations.
