2. The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 354(A)(B), 504, 506 of the Indian Penal Code and later on, Section 302 of the Indian Penal Code was added.

3. As per prosecution case, all 16 F.I.R. named accused persons, including this petitioner, assaulted informant and his family members. This petitioner, along with two other accused persons, is alleged to have assaulted Kameshwar Yadav by means of Farsa as a result of which Kameshwar Yadav

Patna High Court CR. MISC. No.28285 of 2025(2) dt.04-07-2025 2/3 sustained three injuries.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, due to petty dispute, an altercation took place between the parties. There is case and counter-case between the parties. Injuries sustained by Kameshwar Yadav is simple in nature. It is further submitted that similarly situated co-accused person, namely Surendra Kumar @ Surendra Yadav, has already been granted bail by this Hon'ble Court vide order dated 05.03.2025 passed in Cr. Misc. No. 1144 of 2025. Chargesheet has already been submitted and petitioner is in custody since 23.12.2024. Petitioner claims clean antecedents.

5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case, claim based on parity, period of custody and clean antecedents of the petitioner, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Jamui in
