JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-11-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is in custody in connection with Mehandia P.S. Case No. 77 of 2017 for offences under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner would submit that the petitioner has no criminal antecedent so far as the case under the provisions of the Bihar Prohibition and Excise Act is concerned. Learned counsel further submits that the petitioner is neither owner of the liquor nor owner of the vehicle. Petitioner is in custody since 03.03.2020. Considering the period of custody of the petitioner, the Court is inclined to grant bail to him, subject to the

On depositing the amount of Rs.1,00,000/-, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.1,00,000/-(Rupees one lakh) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge II cum Special Judge Excise, Jehanabad in connection with Mehandia P.S. Case No. 77 of 2017.
