The petitioner seeks bail in connection with Kurhani P.S. (District Muzaffarpur) Case No. 136 of 2020, G.R. No. 419 of 2020 for the offence under Section 30(a) of Bihar Excise and Prohibition Act, 2016.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, nothing has been recovered from the conscious possession of the petitioner and the petitioner has no concern with the alleged recovery. The petitioner is rotting in judicial custody since 20.06.2020. Learned A.P.P. for the State has opposed the prayer

Patna High Court CR. MISC. No.30695 of 2020(2) dt.18-12-2020 2/2 for bail and submitted that the petitioner has also got criminal antecedent other than this case.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Kurhani P.S. Case No. 136 of 2020/ G.R. No. 419 of 2020.
