JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-09-2022 At the outset, learned counsel for the petitioners submits that petitioner no. 4 namely Sushil Kumar Singh has been arrested and as such, he seeks permission to withdraw this petition, so far as petitioner no. 4 is concerned. Accordingly, in respect of petitioner no. 4, this petition is dismissed as withdrawn.

Heard learned counsel for the petitioners and learned Addl. Public Prosecutor.

No.29974 of 2022(2) dt.29-09-2022 2/3 The petitioners (i.e. petitioners no. 1 to 3) apprehend their arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code. As per F.I.R., all the accused persons including these petitioners, armed with lathi, iron rod and khanti, assaulted the servant of the informant and when the informant alongwith others came to save him, it is alleged that all the accused persons also assaulted them.

It is submitted on behalf of petitioners that petitioners are agnates of the informant. There is case and counter case. Allegation of abuse and assault is general and omnibus. Specific allegation of assault is against other co-accused persons. Petitioners have got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the general and omnibus nature of allegation and clean antecedent of petitioners, let petitioners no. 1, 2 and 3, as named above, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Arwal in connection with Arwal P.S. Case No.
