Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Main P.S. Case No. 17 of 2021 registered for the offences under Sections 147, 148, 149, 341, 323, 324, 379, 386, 307, 504, 506 of Indian Penal Code and Section 27 of the Arms Act. As per the allegation made in the FIR, the informant has alleged that the present petitioner along with other accused persons came at the shop of the informant and asked to serve cold drink to which the informant responded that the cold drink was not available upon which the accused persons started

No.30046 of 2022(3) dt.19-10-2022 2/3 abusing him and one Bittu Kumar snatched Rs. 10000/- from the possession of the informant and petitioner opened fire at the informant's younger brother who sustained injuries at his leg. Further allegation is that after the incident the unknown accused persons assaulted the informant's father and made a demand of one lac rupees by threatening them.

The main submissions advanced by the learned counsel Mr. Prithivi Raj Singh for the petitioner are that the petitioner has been languishing in jail since 04.10.2021, in fact the petitioner is a friend of co-accused Bittu Kumar owing to this reason he has been dragged in this case, there is no independent witness in the instant matter and the petitioner is a student and against him the investigation has been completed. Learned APP Mr. Jai Narain Thakur appearing for the State as well as learned counsel appearing for the informant has opposed the bail prayer.

Heard both the sides and perused the FIR, case diary and injury report of the injured namely Ranvir Kumar. As per the allegation the petitioner fired three shots at the brother of the informant during the alleged occurrence and in that firing the informant's brother sustained one fire-arm injury at his leg. Considering these facts and the nature of the allegation appearing against the petitioner, in the opinion of this Court the petitioner does not deserve the privilege of bail. Accordingly, his bail prayer stands rejected.

The Trial Court is directed to expedite the trial of the petitioner and take steps to conclude the same as early as possible. If the trial of the petitioner is not concluded in the next one year then the petitioner may renew his bail prayer. (Shailendra Singh, J.) murli/- U T
