1. Heard learned counsel for the petitioners and learned counsel for the respondents.
2. The petitioners have filed this application for
Patna High Court CWJC No.2053 of 2012(7) dt.05-10-2023 2/2 directing the respondents to appoint them on the post of Primary (block) Teacher in the school situated at Block Chenari in the District of Rohtas. Learned counsel for the petitioners submits that so far as petitioner no.2 is concerned, his application has already been dismissed as withdrawn by order dated 15.5.2012. As per instructions received the petitioner no.1 already having got appointment, his case also does not survive.
3. So far as petitioner no.3 is concerned, learned counsel for the petitioners submits that with the 2012 Rules having been framed by the State Government, it is mandatory for any candidate to have passed the Teacher Eligibility Test for appointment as a Primary (Block) Teacher but the petitioner no.3 has not cleared the same.
4. In view of the above facts he is not pressing this application and seeks permission to withdraw the same.
