The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 504, 506 of the Indian Penal Code and 27 of the Arms Act in which section 302 IPC was added later on.

The prosecution case in short is that the accused persons, variously armed, assaulted the father of the informant due to which he sustained injuries and later died during treatment.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.01.2019. There is no allegation of tampering of witnesses alleged against the

Patna High Court CR. MISC. No.30923 of 2020(3) dt.06-01-2021 2/2 petitioner. Charge-sheet has been submitted in the present case. The petitioner has falsely been implicated in the present case. Altogether 23 persons are named in the F.I.R.. General and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar Mufassil P.S. Case No. 375 of 2019.
