JUSTICE SANJAY PRIYA ORAL ORDER 3/ 23-03-2018 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner apprehends his arrest in Gaurichak P.S. Case No.263 of 2017 instituted for the offence under Section(s) 302, 120-B/34 Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate, VII, Patna City. It is alleged in the written report that this petitioner and other accused persons had taken away minor son of the informant, Chandan Kumar, aged about 13 years and caused his death by strangulation and threw the dead body in water. Case diary has been received. Witness in para 12 of the case diary has supported the case. Post mortem report is available in the case diary, wherein, doctor has found injuries on the neck of the deceased and dead body was recovered from the
Patna High Court Cr.Misc. No.61671 of 2017 (3) dt.23-03-2018 2/2 pond.
In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.
Prayer of the petitioner for grant of anticipatory bail is rejected.
Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law merit without being prejudiced by this order.
