JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------- 07-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Araria P.S. Case No.656 of 2016 registered under Section 379 and, later on, added Section 411 of the Indian Penal Code. The accusation is that the informant parked his motorcycle in front of the clinic of Dr. Satyavardhan and went at the clinic. When the informant came out of the clinic, he did not find his vehicle parked there. On video clippings, the informant came to know that his motorcycle was theft by Soyeb. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. nor his photograph was

No.56661 of 2017 (2) dt.07-12-2017 2/2 identified in the video clipping rather his name has been disclosed by Soyeb, who in his confessional statement has stated that this petitioner alongwith others were present nearby the place of the occurrence. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Araria P.S. Case No.656 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
