JUSTICE MADHURESH PRASAD ORAL ORDER 24-07-2019 Heard counsel for the petitioners and counsel for the respondents-State as well as counsel for Accountant General. Claim has been made for grant of monetary benefit of revision to the petitioners in terms of the Finance department Resolution dated 23.09.2009 as amended by the Finance department Resolution dated 08.08.2012.
Counter affidavit has been filed by the Staterespondents after due service upon counsel for the petitioners in September, 2015 itself.
Patna High Court CWJC No.8352 of 2015(3) dt.24-07-2019 2/2 Specific stand in the counter affidavit from paragraphs 8 to 12 is that due and admissible benefit on account of revision has been granted to the petitioners. Reliance is placed on communication dated 04.08.2015. Detail of benefit granted to the petitioners individually has also been stated in the counter affidavit in the said paragraphs. Petitioners have not filed any rejoinder or reply disputing the said averment made in the counter affidavit.
In the circumstance, admitted position is that benefit has been granted to the petitioners. Therefore, petitioners do not require any order.
Writ petition is disposed of.
