====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 10-08-2023 Heard learned counsel for the petitioner and learned counsel for the State.

2. Counsel for the petitioner has challenged the order dated 05.12.2014 / 16.12.2014 issued under Letter No.- 138 of 14 -863 passed by Chairman, Bihar Bhoodan Yagna Committee, Patna. Counsel submits that the said order has been passed without granting any opportunity of hearing.

3. Counsel for the State submits that the said order is

Patna High Court CWJC No.10879 of 2015(3) dt.10-08-2023 2/2 appealable under Section 17 of the Bihar Bhoodan Yagna Act, 1954 (Bihar Act 22 of 1954) ( hereinafter referred to as 'the Act of 1954').

4. In this view of the matter, this writ petition is allowed directing the petitioner to avail remedy under Section 17 of the Act of 1954.

5. It is made clear that till disposal of the appeal, no coercive steps be taken on the basis of Letter No.- 138 of 14 -863 dated 05.12.2014 / 16.12.2014.

6. With the aforesaid direction, the present writ application is hereby disposed of.
