Petitioner apprehend his arrest in Laheriasarai P.S. Case No.16 of 2019, registered under Sections 414 of the Indian Penal Code and under Sections 25 (1-b)a/26/35 of the Arms Act. The informant alleged that two persons came on motorcycle bearing registration no. BR 07AA-1790 but on being signaled to stop, the driver of the motorcycle fled away leaving the motorcycle on the spot. The pillion rider was apprehended who disclosed his name as Sivanand Kumar Sah. Sivanand Kumar Sah disclosed the name of the petitioner who was driving the motorcycle. From possession of Sivanand Kumar Sah loaded country made pistol was recovered. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.26875 of 2019(2) dt.24-04-2019 2/2 petitioner is the owner of the motorcycle. The petitioner annexed the photocopy of the owner book of the motorcycle as Annexure-2. The petitioner went to his house to bring money to deposit the fine imposed on him by the police for not bearing the helmet but the police lodged the case.

Considering the facts that the petitioner was moving on his motorcycle but on being signaled by the police, the petitioner fled away and his accomplish was arrested and from his possession arms and ammunition was recovered, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
