This application, for grant of anticipatory bail, arises out of Begusarai Muffasil Police Station Case No. 121 of 2018, disclosing offences under Sections 394 of the Indian Penal Code. Allegation as per F.I.R. is that informant was going to purchase a cow and calf for Rs. 80,000/-, upon returning from, some miscreants came on motorcycle and looted away his belongings and one of them was apprehended, who disclosed the name of petitioner as his associate.
Submission of learned counsel for the petitioner that he has been made accused in this case only on the basis of confession of co-accused and except that there is nothing against
Patna High Court Cr.Misc. No.41093 of 2018 (2) dt.17-07-2018 2/2 the petitioner and though he is an accused in one more case but he is on bail in that case.
Considering the facts and circumstances of the case and the nature of allegation as well as the fact that petitioner is an accused in one more case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather he should surrender before the court below and pray for regular bail, which will be decided by the court below on the merit of the case, without being prejudiced by the order of this court.
