The petitioners apprehend their arrest in Pratapganj P.S. Case No. 20/2018, registered for the offences punishable under Sections 363, 366A, 379 and 34 of the Indian Penal Code. The informant alleged that the petitioners and Yusuf Ansari kidnapped the minor daughter of the informant on 30.01.2018 in the night.

Learned counsel for the petitioners submits that Yusuf Ansari is the son-in-law of the informant. The petitioners are own brothers of Yusuf Ansari. Petitioners never visited at the house of the informant. Yusuf Ansari enticed his sister-in-law who is still traceless and petitioners have no manner of concern. The daughter

It is further submitted that if the informant knew this fact he would have lodged the case immediately after the occurrence said to have taken place on 30.01.2018, but the information to the police was given on 19.02.2018.

Considering the facts aforesaid and nature of allegation made against the petitioners and the fact that petitioners are brothers of Yusuf Ansari son-in-law of the informant who is alleged to have kidnapped his own sister-in-law, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Birpur, Supaul in connection with Pratapganj P.S. Case No. 20/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
