JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Sitamarhi (Mehsaul O.P) P.S. Case No.448 of 2019 for the offence under Sections 25(1-b)a, 26 and 25 of the Arms Act. Learned counsel appearing on behalf of the petitioner would submit that it is true that certain cases are pending against the petitioner but in the present case, there is no material against him to connect with the commission of crime. The petitioner was apprehended at Barauni Junction and nothing was recovered from his possession. Later on, the police conducted raid in the house at Shanti Nagar where one country made pistol and four live cartridges were recovered. Petitioner is in custody

Considering the fact that the petitioner has remained in custody for nearly ten months, the Court is inclined to grant bail. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi (Mehsaul O.P) P.S. Case No. 448 of 2019.
