JUSTICE SANJAY PRIYA ORAL ORDER 09-05-2019 Heard the learned counsel for the petitioner, the informant and the learned A.P.P. for the State. The petitioner seeks bail in Chanpatiya P.S. Case No. 515/2018, instituted for offences under Section(s) 341, 342, 323, 307, 387, 504, 506/34, 302/120B of the Indian Penal Code read with Section 27 of Arms Act.

It is alleged in the written report that while informant was going with his father on motorcycle and reached at Siswaniya more then six persons including this petitioner came on two motorcycles. It is alleged that this petitioner and Divakar Pathak gave order to kill the father of informant and started pulling his father. Thereafter Vinay Pathak opened fire on his father.

Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.30622 of 2019(2) dt.09-05-2019 2/2 there is specific allegation against Vinay Pathak of causing firearm injury to the father of informant. There is no allegation of specific overt act against this petitioner. Learned counsel for informant has opposed the prayer for bail of petitioner.

Petitioner is in custody since 25.12.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bettiah, West Champaran, in connection with Chanpatiya P.S. Case No. 515/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
