Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420, 370, 370(5), 370(6), 372, 373, 376-DA, 420-B/34 of the Indian Penal Code, Sections 4, 6, 8, 17 of the Protection of Children from Sexual Offences Act, Sections 3, 4, 5, 6, 7, 8 of the Immoral Trafficking Prohibition Act, Sections 3(i)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and and Section 37 of Bihar Prohibition Excise Act, 2016.

3. The allegation against this petitioner is to involve in running a sex racket in private guest house from where two girls with a man were apprehended, where certain objectionable materials were also recovered

4. It is submitted that during course of investigation,

No.30395 of 2023(3) dt.24-07-2023 2/2 only material that has come against this petitioner is that one of the girls has only asserted that on one occasion this petitioner has given some money to her and except this, there is no allegation against this petitioner of being involved in running a sex racket in private guest house. Petitioner has got clean antecedent.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI-cum-Special Judge, POCSO, Bettiah, West Champaran in connection with Bettiah Mahila P. S. Case No. 04 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
