JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-12-2023 The present writ petition has been filed seeking the following reliefs:- "1.(a) To issue an order/orders, the nature of Certiorari to set aside the order dated 06.08.2022 passed in Complaint Case No.19 of 2021 by the learned Court of District
2/4 Programme Officer ICDS, East Champaran at Motihari (Respondent No.4) wherein & where under the petitioner has been terminated from the post of Aaganbari Sevika employed in Gram Panchayat Belahi Ram, ward No.-4 on the ground that the educational certificate produced during employment is alleged to be not recognised by the state as the petitioner is said to have passed matriculation Examination from Central Open School Educational Institution, Uttar Pradesh, Lucknow.
(b) To pass an order/orders, the nature of mandamus Commanding upon the Respondents concerned to go with the Sankalp No.13584 dated-01.10. 2019 as contained in Annexure-9 wherein & where under it has been observed that the certificate obtained by any National Open school is said to be valid for any employment in the state of Bihar and the same is notified in the Sankalp, Bihar Government by the Personnel & Administrative Department.
3/4 (c) to issue an order/order direction/ directions, writ/writs in the nature of a mandamus commanding upon the respondents concerned to go with the order dated 21.07.2020 vide Memo No.-419, in Appeal case No.- 03/2019 as contained in Annexure12 wherein & where under the learned court has considered the Sankalp No.-13584 dated01.10.2019 wherein it has been laid down that the Certificate obtained from Central Open School, is said to be valid for the employment in the state of Bihar.
(d) To pass an order/orders, the nature of Mandamus Commanding upon the respondents concerned to go with the order dated 02.02.2021 passed in Aanganbari Case No.14 of 2020 (Pushpa Kumari Vs. Shobha Kumari) wherein the learned court has been pleased to consider the Sankalp No.-13584 dated 01.10.2019, where it has been held, the certificate obtained from National Open School, is said to valid for the
4/4 employment in the State of Bihar and the same is said to be continued in Annexure-13."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, for redressal of the aforesaid grievances. Liberty, so sought, is granted.

The writ petition stands dismissed as not pressed.
