====================================================== CORAM: HONOURABLE MR. JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 06-05-2026 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 126 (2), 127 (2), 115 (2), 308 (5) and 3 (5) of B.N.S, 2023.

3. The case of the prosecution, in short, is that the informant along with others was going on a rented Scorpio along with the purchased motherboards. It is further alleged that some unknown miscreants on a black colour Scorpio took them 20 K.M. ahead of Muzaffarpur to a secluded place and demanded ten lakh rupees as an extortion money. It is further alleged that they also assaulted the informant and took Rs. 50,000/- from their phone pay account.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel

No.29032 of 2026(2) dt.06-05-2026 2/2 for the petitioner has submitted that during course of the investigation, this petitioner has given his confessional statement and the amount which was transferred through phone pay was received in the account of this petitioner. Learned counsel for the petitioner has submitted that there is business relationship between the petitioner and the informant and there was due with the informant which was paid to him. It is further been submitted that same and except the confessional statement, there is nothing against him. Nothing has been recovered from the possession of the petitioner. Moreover, the petitioner is languishing in judicial custody since 24.02.2026 having no criminal antecedent..

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chakia P.S. Case No. 78 of 2026 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Motihari.
