Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 16.10.2017 passed in Cr. Misc. No.25601 of 2017 and again order dated 10.10.2018 passed in Cr. Misc. No.51515 of 2018 and the allegation is about recovery of 40 kg. of Ganja from the Car and the petitioner is Driver of the said vehicle.

Submission of the learned counsel for the petitioner is that he is in custody for about 2 1⁄2 years and up till now not a single witness has been examined in this case though the charge has been framed..

Heard learned A.P.P. and perused the report also.. In such view of the matter, let the petitioner, above

Patna High Court CR. MISC. No.33291 of 2019(3) dt.24-07-2019 2/2 named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Addl. Sessions Judge, Nawada in connection with N.D.P.S.case No.01 of 2017 dated 1..2.2017 and P.R.Case No.155/17 dated 1.2.2017 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled. With the aforesaid direction, this application is allowed.
