====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 18-04-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 363, 364, 302, 201/ 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 15.04.2021, he is a person with clean antecedent, charge-sheet has been submitted in the case and is a woman.

The learned counsel for the petitioner submits that the informant alleges that on 20.02.2018 at about 4.00 P.M., the daughter of the informant (deceased) was taken by the named accused persons along with other two accused persons for the purposes of marriage. It is further alleged that on 23.02.2018,

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the case. She is not named in the F.I.R. and her name came on the confessional statement of co-accused Abed and Sarfaraz. It is further submitted that Md. Abed @ Abed @ Aabeed has been granted bail by order dated 24.04.2019 in Cr. Misc. No.25422 of 2019, Nawed @ Nawej Taksir @ Nawej has been granted bail by order dated 03.12.2018 in Cr. Misc. No.55425 of 2018, Md. Sarfraj @ Sarfraj has been granted bail by order dated 10.12.2018 in Cr. Misc. No.70989 of 2018 and Md. Rahil has been granted bail by order dated 28.03.2019 in Cr. Misc. No.5637 of 2019.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in the case and is a woman and co-accused have been granted bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like

Patna High Court CR. MISC. No.39091 of 2021(3) dt.18-04-2022 3/3 amount each to the satisfaction of learned Court below where the case is pending in connection with Jokihat (Mahalgaon) P. S. Case No.51 of 2018.

The application stands allowed.
