JUSTICE RAJESH KUMAR VERMA ORAL ORDER 12-05-2026 Heard Mr. Sunil Kumar, learned counsel for the petitioner, Mr. Ram Prakash Kumar, learned counsel for the informant and Mr. Manoj Kumar, learned Additional Public Prosecutor for the State.

2. Petitioner seeks bail who is in custody since 07.02.2026 in connection with Kowakol P.S. Case No. 480 of 2025, F.I.R. dated 01.12.2025 for the offences punishable under Sections 191(2), 191(3), 190, 329(3), 324(4)(5), 115(2), 118(1), 117(2), 109, 103(1) and 61(2) of the BNS, 2023.

3. According to prosecution case, over a property dispute this petitioner along with other accused persons brutally assaulted the informant and his family members due to which

2/4 the informant's cousin brother died during the course of treatment.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and she has falsely been implicated in the present case. He further submits that it appears from the FIR itself that due to admitted land dispute the present occurrence has taken place. Although the petitioner is named in the FIR but from perusal of the FIR it appears that there is no specific allegation of assault or overt act against the petitioner rather there is general and omnibus allegation against all the accused persons including the petitioner and petitioner is the wife of the co-accused, namely, Rajendra Sao and there is specific allegation against Rajendra Sao that he has assaulted to the deceased and on the basis of the fact that petitioner is the wife of Rajendra Sao, she has been implicated in the present case. He further submits that there is specific allegation against co-accused, Rajendra Sao, Umesh Sao and Dharmendra Sao. He further submits that the police after investigation submitted the charge sheet against the petitioner. The petitioner is in custody since 07.02.2026.

5. The learned counsel for the informant as well as learned Additional Public Prosecutor have vehemently opposed

3/4 the prayer for bail of the petitioner and submits that the petitioner has participated in the present crime in question.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Nawada in connection with Kowakol P.S. Case No. 480 of 2025, subject to the following conditions:- i. Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on her absence on two consecutive dates without sufficient reason, her bail bond shall be cancelled by the Court below. ii. If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.

iii. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed her criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order

4/4 shall not be delayed for purpose of or in the name of verification.
