The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. The petitioner apprehends his arrest in connection with Thakaraha (Bhitaha) P.S. Case No. 149 of 2017 registered for the offence punishable under sections 420, 467, 468, 471, 353, 120(B), 34 of the Indian Penal Code.

As per allegation, co-accused Chandan Kumar Yadav, who was resident of Uttar Pradesh, obtained forged caste certificate and on that basis he wanted to obtain government service. The allegation against the petitioner is that being the husband of Mukhiya, he has created the forged letter pad on which the certificate was granted.

The learned counsel for the petitioner has submitted that

No.25462 of 2020(6) dt.14-12-2021 2/2 the petitioner did not issue any certificate, neither obtain the letter pad and said signature of the petitioner on the letter pad is forged and fabricated. He has further submitted that the person, who has produced the certificate for obtaining service (Chandan Kumar Yadav), has been granted anticipatory bail by the coordinate Bench in Cr. Misc. No. 60808 of 2017, vide order dated 21.12.2017. Considering the above mentioned facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.

10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Bagaha, West Champaran in connection with Thakaraha (Bhitaha) P.S. Case No. 149 of 2017, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
