2. The petitioner seeks bail in connection with Sarsi P. S. Case No. 191 of 2024, dated 19-10-2024 instituted for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1),117(2),109, 74, 303(2) and 103 of the Bharatiya Nyaya Sanhita 2023.

3. The prosecution case, in short, is that fifteen persons have been named in the FIR, with the allegation of assault on the deceased being general and omnibus in nature against all of them.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that although there is no

Patna High Court CR. MISC. No.29696 of 2025(2) dt.15-05-2025 2/2 allegation that the petitioner assaulted the deceased, the only accusation against him is that he called the deceased from his house. It is further submitted that four other named co-accused persons have been granted bail by a Co-ordinate Bench of this Court vide order dated 06.05.2025 passed in Cr. Misc. No. 27007 of 2025. The petitioner has been in judicial custody since 20.10.2024 and has no criminal antecedents. The charge sheet has already been submitted in this case.

5. Learned A.P.P. has opposed the prayer for bail.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Purnea/concerned court below, in connection with Sarsi P. S. Case No. 191 of 2024.

7. The application stands allowed.
