Apart from the fact that the counsel for the State has raised objection on account of the petitioner's admission in response to second show cause. It is also submitted that if at all petitioner had any ground, he should have approached the appellate authority i.e. Commissioner, Patna, respondent no. 2. In view of the aforesaid submissions, this court is of the opinion that the petitioner has statutory, alternative and adequate remedy to approach the respondent no. 2. If the petitioner approaches the appellant authority within two weeks from today,

Patna High Court CWJC No.8859 of 2015(2) dt.04-09-2019 2/2 the respondent no. 2 would be obliged to consider the same in accordance with law on its merit without raising the issue of same being time barred. It is expected that he would be disposed of the matter expeditiously and without any undue delay.

The instant writ petition is disposed of.
