Petitioner seeks bail in Khudaganj P.S. Case No.27 of 2018 instituted for the offence under Section(s) 8/20(A)(i), 29, 20, 22 of the NDPS Act.

Counsel for the petitioner submits that Petitioner is in custody since 22.02.2019 having clean antecedents. He was not present at the time of alleged recovery of Ganja. Seizure list is part of the First Information Report, which will show that 3.500 Kg. is alleged to have been recovered from the room where husk were kept. The seizure list does not bear signature of the petitioner.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner,

Patna High Court CR. MISC. No.28468 of 2019(2) dt.06-05-2019 2/2 above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Nalanda, Biharsharif, in connection with Khudaganj P.S. Case No.27 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
