JUSTICE SATYAVRAT VERMA ORAL ORDER 07-03-2022 Heard learned counsel for the petitioner, Mr. Satyendra Prasad, learned A.P.P. for the State and Mr. Ranjeet Kumar Pandey, learned counsel for the informant. The petitioner seeks bail in connection with Kuchaikote P.S. Case No. 508 of 2020 instituted for the offences under Sections 341, 323, 324, 325, 307, 302, 504 and 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 01.01.2021 is a person with clean antecedent and charges have been framed.

At this stage, learned counsel for the Informant submits that the trial is near completion but only the doctor and the Investigating Officer remain to be examined.

No.39114 of 2021(3) dt.07-03-2022 2/2 Learned counsel for the petitioner does not dispute the submission made by the learned counsel for the informant but submits that he is willing to withdraw the case since the trial is nearing completion but the doctor and the Investigating Officer have not appeared on some dates.

Permission is accorded.

Accordingly, the application dismissed as withdrawn. However, the Superintendent of Police, Gopalganj is directed to ensure that the official witnesses are produced before the learned Court below, so that the trial is completed expeditiously, preferably within a period of six months as directed by order dated 21.01.2022 passed in Cr. Misc. No. 28083 of 2021. Hope the Superintendent of Police, Gopalganj will ensure production of witnesses without undue delay. (Satyavrat Verma, J) Jagdish/- U T
