2. The petitioner seeks regular bail in connection with Mushahari P.S. Case No. 113 of 2024 registered for the offence under Sections 302, 420, 379, 323 & 504 of the IPC.

3. The petitioner is the husband of the deceased. He is alleged to have killed the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 29.11.2024. He further submits that the children of the deceased are staying with the family of the petitioner.

5. Learned A.P.P. appearing for the State has

Patna High Court CR. MISC. No.30934 of 2025(2) dt.15-05-2025 2/2 vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case as well as the submission of the learned counsel for the petitioner, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur/concerned Court below in connection with Mushahari P.S. Case No. 113 of 2024 subject to condition that:- (i). At the time of accepting the bail bonds of the petitioner, the Court below will verify the fact whether the children of the deceased are staying with the family of the petitioner or not. If it is found that the children are staying with the family of the petitioner then only the bail bonds of the petitioner shall be accepted. If the same is found to be false, then the bail bonds of the petitioner shall not be accepted by the Court below.
