Although the petitioner's case is to rehabilitate the displaced persons of the Scheduled caste community situated in village/Taluka Leelabagh under Gram Panchayat Kanchanpur, Block-Anchal in the District of Aurangabad but a preliminary objection has been raised by Mr. Devendra Kumar Sinha, learned AAG 2 regarding the maintainability of the writ petition inter alia on the ground of lack of personal interest of the petitioner. The writ petition is filed in a representative capacity and the petitioner has prayed for rehabilitation of such displaced persons, who belong to the schedule caste community. It is submission of Mr. Sinha that any such application for settlement is

Patna High Court CWJC No.7871 of 2015 (2) dt.21-05-2015 to be filed by the aggrieved person before the District Magistrate concerned and who is empowered to consider such grievance and pass appropriate orders.

Having heard learned counsel for the parties, this writ petition is disposed of with liberty to the person aggrieved to raise their grievance before the District Magistrate, Aurangabad and which shall be considered and disposed of in accordance with law.
