2. The petitioner is apprehending her arrest in connection with Lodipur P.S. Case No. 18 of 2026 registered for the offence under Sections 191(2), 191(3), 190, 126(2), 115(2), 117(2), 109(1), 76, 324(4), 303(2), 352 and 351(2) of the B.N.S., lodged on 23.01.2026 by the informant, Komal Devi.
3. As per the prosecution story, the informant who is widow of Late Surendra Yadav alleged that due to dispute between the family, the elder brother-in-law (Bhaisur) and the father-in-law (Sasur) assaulted her, outraged the modesty and also resorted to damage the household materials beside taking away cash/ornaments. She was shifted to hospital and then the F.I.R.
4. Learned counsel for the petitioner submits that a
Patna High Court CR. MISC. No.30115 of 2026(2) dt.18-05-2026 2/3 perusal of the F.I.R. would show that main allegation is against Sadhu Yadav and Dinesh Yadav, she being the housewife and being wife of Dinesh Yadav got implicated.
5. Learned APP opposes the prayer.
6. Taking into account the submissions of the parties as also that main role has been assigned to Sadhu Yadav and Dinesh Yadav, she is a lady and there is no direct allegation against her, in that background, this Court is inclined to extend her the privilege of anticipatory bail.
7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bhagalpur, in connection with Lodipur P.S. Case No. 18 of 2026 subject to the following conditions:- (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document (Aadhar Card/Voter Id/Driving License/Pan Card) to show his/her bona fide;
(ii) the petitioner shall be appearing before the Police Station as and when required for cooperating in the
Patna High Court CR. MISC. No.30115 of 2026(2) dt.18-05-2026 3/3 investigation;
(iii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her bail bond by the Trial Court itself;
(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of bail bonds. (Rajiv Roy, J) vinayak/- U T
