2. The petitioner is a P.D.S. dealer under Kahalgaon Block in the district of Bhagalpur. His license has been suspended on 06.01.2012 in view of pendency of a criminal case under Section 7 of the Essential Commodities Act.
3. The petitioner submits that after 2011 amendment, the power to suspend the license pending criminal case provided under 2007 Order has been Omitted.
4. In this view of the matter, the impugned order suspending the license of the petitioner is set aside with liberty to the respondents to proceed afresh in accordance with law.
5. This application stands disposed of.
