JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 28-04-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned counsel for the informant.

The petitioner apprehends his arrest in connection with Udawant Nagar (Gajrajganj) P.S. Case No. 204 of 2020, registered for the offences punishable under Sections 341, 323, 379, 498 A of the Indian Penal Code and 3/4 of Dowry Act.

It is a case of matrimonial dispute. As per allegation, the petitioner tortured the informant for non-fulfillment of dowry demand.

During course of hearing, it was informed that the

No.13214 of 2021(5) dt.28-04-2022 2/2 informant Runi Kumari, has also filed a case for maintenance under Section 125 of the Cr.P.C. in the court of Principal Judge Family Court, Ara. The petitioner is ready to pay interim maintenance during pendency of that maintenance petition at the rate of Rs. 3,000/- (Three Thousand) per month to the informant to which the learned counsel for the informant also consented.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Udawant Nagar (Gajrajganj) P.S. Case No. 204 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C., with the further condition that if the petitioner retracts from his words, the learned court below shall be at liberty to cancel his bail bond.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
