The petitioner apprehends his arrest in connection with Manjhi P.S. Case No. 05 of 2018 registered under Section 379 of the Indian Penal Code.

The accusation of informant, Surendra Sahini, is that he along with his friend, Arbind Sahni, had gone to Block Office, Manjhi for obtaining the caste certificate on motorcycle bearing registration no. BR 29W 3971 of his brother, Rajendra Prasad. After parking the aforesaid motorcycle, he entered in the office and when he returned from the office found that his motorcycle was missing. He gave written information to Manjhi Police Station and the Officer-in-Charge assured to lodge the

Patna High Court Cr.Misc. No.42541 of 2018(2) dt.19-07-2018 2/3 case but the same was not lodged. Later on, in course of checking of vehicles, his motorcycle was seized from the petitioner, regarding which, Bhagwanpur P.S. Case No. 217 of 2017 has been instituted.

Learned counsel for the petitioner submits that petitioner was apprehended by the police showing the recovery of motorcycle and, accordingly, Bhagwanpur P.S. Case No. 217 of 2017 was instituted, in which, petitioner was remanded in judicial custody, but later on, he was released on bail and regarding the said motorcycle the present case has been lodged. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate -V, Saran at Chapra in connection with Manjhi P.S. Case No. 05 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
