JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-12-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 302 and other ancillary sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, petitioner fired on the chest of the brother of the informant. Other accused persons also fired on him causing his death.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. First Information Report has been lodged on 7.8.2021 for the offence of 5.3.2021 and there is no explanation of delay. There is land dispute between he parties. Similarly situated co-accused Gudu Yadav a gainst whom there is allegation of firing, has already been allowed

Patna High Court CR. MISC. No.39496 of 2021(2) dt.14-12-2021 2/2 bail by a co-ordinate bench of this Court vide paragraph 16 of the bail petition. Petitioner has claimed clean antecedent and he is in custody since 13.11.2019.

Considering the aforesaid facts and circumstances of the case, period of custody and Similarly situated co-accused has already been allowed bail by a co-ordinate bench of this Court, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II, Nalanda in Manpur Police Station Case No. 134 of 2019.
