JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 08-08-2018 This application under section 482 of the Code of Criminal Procedure (for short 'the Cr.P.C.') has been filed by the petitioner for quashing the order dated 12.07.2017 passed by the learned Special Judge (SC/ST), Sitamarhi in SC/ST P.S. Case No. 45 of 2016 whereby cognizance of the offences punishable under various provisions of the Indian Penal Code and Section 3(1)(s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 has been taken and the petitioner and four others have been summoned to face trial.

In view of the statutory provision of appeal prescribed under Section 14-A of the Scheduled Castes and the Scheduled

Patna High Court Cr.Misc. No.2255 of 2018 (2) dt.08-08-2018 2/2 Tribes (Prevention of Atrocities) Act, 1989 (for short 'the Act'), this application filed under Section 482 of the Cr.P.C. would not be maintainable.

Accordingly, this application is disposed of as not maintainable with liberty to the petitioner to assail the impugned order by way of filing an appeal in accordance with law under the Act.

In case the petitioner furnishes a photo-copy of the impugned order passed by the learned Special Judge, Sitamarhi, the Registry shall return the certified copy of the order impugned to the learned counsel for the petitioner after retaining the photo copy on record.
