1. No one appears on behalf of the petitioners.
2. Learned counsel for the State is present.
3. Learned counsel appearing for the opposite party no. 2 submits that the present application has been preferred by the petitioners against the order, dated 16.10.2017, passed by learned Additional Sessions Judge III, Bettiah, West Champaran in Sessions Trial No. 289 of 2017 (arising out of Shikarpur Police Station Case No. 218 of 2012 under Section 227 of the Criminal Procedure Code), which was dismissed.

4. Learned counsel informs that during the pendency of this application, the stage of the case has changed and after framing of charges, all the prosecution witness have been examined and official witness i.e. Investigation Officer/Doctor are yet to be examined.
5. In view of the aforesaid submissions and taking into consideration the fact that the stage of the case, before the trial court, has now changed, I do not find any reason to interfere with the impugned order.
