In this case, the petitioners are seeking anticipatory bail in connection with Barh P.S. Case No.55 of 2019, registered for the offence under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

Allegation has been made that the petitioners came to a hotel and gave order for meal, after some time, some hot discussion took place between the nephew of the informant and the petitioners, thereupon, the petitioners assaulted the nephew of the informant in such a manner he became senseless.

Patna High Court CR. MISC. No.29287 of 2019(2) dt.03-05-2019 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within three weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court. While deciding the bail petition, the Court below will examine the injury report as it has been submitted by learned counsel for the petitioners that the nephew of the informant has not sustained any injury.
