Mr. Addl Public Prosecutor ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-12-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor representing the State through video conferencing.

The petitioner apprehends arrest in a case registered for the offence punishable under section 302 of the Indian Penal Code and section 27 of the Arms Act.

Learned counsel for the petitioner submits that from perusal of the FIR it appears that the informant's son (the victim) was gossiping with co-accused Dumka but did not return till late night. Thereafter informant came outside in search of her son and found him lying in pool of blood. He submits that informant's son was killed by said co-accused Dumka, who is lone FIR named accused person in the case, and petitioner's name has come during investigation on the basis of confessional statement of co-accused Vikash Kumar Yadav who has already been granted regular bail by a co-ordinate bench of this Court vide order dated 3.6.2020, passed in Cr.Mis.No. 17664 of 2020. Petitioner has got no criminal antecedent as stated in paragraph 3 of the bail petition.

In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in Dharhara Police Station (Hemjapur OP) Case No.250/2019, GRN 2997/2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
