The petitioners apprehend their arrest in Alauli P.S. Case No. 243 of 2017 registered under Sections 147, 148, 341, 323, 447, 307 of the Indian Penal Code and Section 27 of the Arms Act.
The informant, Birendra Yadav, named the petitioners along with other accused persons and alleged that they having armed with different weapons including firearm came, assaulted the informant and made indiscriminate firing. Learned counsel for the petitioners submits that the petitioners are ladies. They have falsely been implicated in this case. From the side of the petitioners, Alauli P.S. Case No. 242
Patna High Court Cr.Misc. No.56097 of 2017 (2) dt.13-12-2017 2/2 of 2007 has been registered and the Petitioner No. 1, Manju Devi, is the informant of that case.
Considering the facts, nature of allegation made against the petitioners and particularly the fact that the petitioners are ladies, the petitioners, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Alauli P.S. Case No. 243 of 2017 to the satisfaction of the learned C.J.M, Khagariya or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
